PRINCIPLES OF PROCESSING AND PROTECTION OF PERSONAL DATA
OF CLIENTS OF PROPERTINO S.R.O.

 

The Personal Data Processing and Protection Policy issued by Propertino aims to inform Clients about the personal data processed by the company, in its capacity as data controller, in the course of providing services in the field of brokerage of the sale, purchase and lease of real estate and other related activities, including the principles governing the processing of personal data when visiting the websites operated by the company and when communicating with potential Clients.

 

The Policy explains the purposes for which personal data are processed, the period for which they are retained in accordance with applicable legal regulations, to whom they may be transferred or disclosed and for what reasons. It also provides information about the rights of natural persons in connection with the processing of their personal data.

 

This Policy applies to the processing of personal data of Propertino’s Clients, as well as their representatives and contact persons, potential clients and individuals interested in the company’s services, and also to visitors to the websites operated by Propertino.

 

 

1. DEFINITIONS OF BASIC TERMS

 

“Propertino” = the company Propertino s.r.o., with its registered office at Platnéřská 88/9, Staré Město, 110 00 Prague 1, Company ID No.: 085 43 666, registered in the Commercial Register maintained by the Municipal Court in Prague under File No. C 320715.

 

“Personal Data” = any information relating to an identified or identifiable natural person, i.e. a natural person who can be identified, directly or indirectly, in particular by reference to a specific identifier (in particular name, birth number, telephone number, email address, IP address of the user’s computer, personal preferences, etc.).

 

“Processing of Personal Data” = any operation or set of operations which is performed on Personal Data or on sets of Personal Data, whether or not by automated means. Such operations include, in particular, collection, recording, organisation, structuring, storage, adaptation, alteration, retrieval, consultation, use, transmission, sharing, disclosure, alignment, combination, restriction, erasure or destruction of Personal Data.

 

“Client” = a natural or legal person who has contacted Propertino for the purpose of receiving or submitting an offer of services, requesting services, concluding a contract, or who has already concluded such a contract with Propertino.

 

“ÚOOÚ” = the Office for Personal Data Protection, with its registered office at Pplk. Sochora 29, Prague 7, Postal Code 170 00.

 

“GDPR Regulation” = Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, andrepealing Directive 95/46/EC (General Data Protection Regulation).

 

“Personal Data Processing Act” = Act No. 110/2019 Coll., on the Processing of Personal Data, as amended.

 

 

2. DATA CONTROLLER AND CONTACT DETAILS OF THE DATA PROTECTION OFFICER

3. LEGAL FRAMEWORK AND PRINCIPLES OF PERSONAL DATA PROCESSING

 

The principles governing the Processing of Personal Data are based on the legal regulations binding upon Propertino, in particular the GDPR Regulation, the Personal Data Processing Act and other related legislation.

 

The fundamental principle of Personal Data Processing observed by Propertino is lawfulness, fairness and transparency towards data subjects. Personal Data are collected only for specific, explicitly defined and legitimate purposes and must not be further processed in a manner incompatible with those purposes. An exception applies to further processing for archiving purposes in the public interest, scientific or historical research or statistical purposes, which is permitted.

 

Propertino ensures that the Processing of Personal Data is adequate, relevant and limited to what is necessary in relation to the purposes for which they are processed (principle of data minimisation), and that Personal Data are accurate and, where necessary, kept up to date. Propertino takes all reasonable steps to ensure that inaccurate data are rectified or erased without undue delay where they no longer serve their intended purpose.

 

Propertino retains Personal Data in a form which permits identification of data subjects only for as long as is necessary for the purposes for which the data are processed (principle of storage limitation). Personal Data may be retained for longer periods only for archiving purposes in the public interest, scientific or historical research, or statistical purposes, provided that appropriate technical and organisational measures are implemented and observed to safeguard the rights and freedoms of data subjects.

Personal Data are processed by Propertino in a manner that ensures appropriate security, including protection by suitable technical and organisational measures. These measures protect the data against unauthorised or unlawful processing and against accidental loss, destruction or damage (principle of integrity and confidentiality).

Propertino places the utmost emphasis on the security of Personal Data from the moment of their collection until their deletion, pseudonymisation or anonymisation. Data are stored and processed in accordance with security standards, and all reasonable measures have been adopted to protect them against misuse or unauthorised access. Internal processes and security policies are designed to ensure maximum data protection.

Trusted processors who handle the data are contractually bound to comply with the same security standards.

However, it should be noted that data transmission over the internet cannot be fully secured, and therefore Propertino cannot guarantee absolute protection of information transmitted to the company’s website.

Propertino processes Personal Data exclusively within the Czech Republic and does not transfer them outside the European Union.

 

 

4. METHOD OF OBTAINING PERSONAL DATA AND THEIR USE

Propertino may collect or obtain Personal Data through various means, such as via its websites, forms, electronic or telephone communication, in-person meetings, or by other methods.

 

In some cases, the data are provided directly by the Client, for example during telephone, email, or in-person contact. In other instances, Propertino obtains Personal Data itself as the data controller, for example through cookies, which allow tracking of how users (Clients) interact with the website. Additionally, Propertino may obtain data as a controller from third parties, such as cooperating real estate agents or real estate agencies.

 

i) Processing of Personal Data Obtained Through Contact with the Client

Propertino collects and processes Clients’ Personal Data during their contact for the purpose of buying, selling, or renting real estate. Personal Data may be obtained directly from the Client or through mutual communication.

 

The Personal Data processed include identification and contact information (e.g., name, date of birth, contact details) and, in the case of financial transactions, payment information. For certain services, additional specific information may also be required (e.g., visa number, purpose of stay).

 

Propertino uses this Personal Data to identify the Client, establish contact, verify identity, and conclude contracts. Processing is carried out based on the performance of a contract (e.g., arranging meetings or property viewings), legal obligations (e.g., under the Act on the Residence of Foreigners in the Czech Republic), or the explicit consent of the Client where required by law (e.g., under the Act on Certain Measures Against the Legalization of Proceeds from Crime and the Financing of Terrorism).

 

ii) Processing of Personal Data for Newsletters and Marketing Communications

Propertino collects Clients’ Personal Data in connection with subscriptions to newsletters and marketing communications. Clients may provide their data directly, for example when registering to receive marketing emails or during communication with Propertino.

The Personal Data processed include email address, first and last name, and any preferred areas of interest. This information allows Propertino to send Clients personalized marketing communications tailored to their preferences. Additionally, Personal Data may be used for analysis and the collection of statistical data, helping to improve the effectiveness of marketing activities.

The legal basis for processing is Propertino’s legitimate interest in tailoring marketing communications, evaluating their effectiveness, and providing relevant information. It also serves to better understand Clients’ needs and improve the services provided. If a Client unsubscribes from marketing communications, Propertino retains their data on an unsubscribe list in accordance with legal obligations, to ensure that no further unsolicited communications are sent.

iii) Processing of Personal Data When Browsing the Website

Propertino collects information about Clients when they browse the website through cookies and similar technologies. These data may be obtained from both Propertino’s website and third-party platforms.

The Personal Data collected include information about user behavior on the website, such as visited pages, viewed videos, favorite properties, searched queries, visit duration, and location. Technical data are also processed, including IP address, browser type, device type, screen resolution, and language preferences.

Propertino uses this data to ensure the proper functioning of the website and applications, to display content tailored to the Client’s preferences, to protect the website from misuse, to diagnose errors, and to perform statistical analyses. Cookies also help evaluate the effectiveness of advertising campaigns and tailor property listings and content based on user behavior.

The legal basis for processing this Personal Data is Propertino’s legitimate interest, which includes ensuring the smooth operation of the website, data protection, and service improvement. Certain functions, such as targeted advertising, content personalization, automatic login, or social media sharing, require the Client’s consent to the use of cookies and marketing communications.

5. DISCLOSURE OF PERSONAL DATA TO THIRD PARTIES (RECIPIENTS)

Propertino may share a Client’s Personal Data for the purpose of fulfilling legal obligations, improving its services, or based on the Client’s consent.

The processing of Personal Data is carried out only by trusted external entities to whom Propertino provides only the information necessary to deliver a specific service. These entities are obliged to protect the data and may not use it for other purposes. Propertino also ensures that all cooperating third parties comply with strict security measures.

Partners who may have access to Personal Data include real estate agents, providers of legal services, IT providers (e.g., hosting platforms, database administrators, and software application providers), property owners, developers, and marketing, advertising, and social media agencies. These entities may use Personal Data, for example, for social media monitoring, customer relationship management, website analytics, targeted advertising, and evaluation of marketing campaign effectiveness.

6. RETENTION PERIOD OF PERSONAL DATA

Propertino retains Clients’ Personal Data only for the period necessary to achieve the purpose of processing, to comply with legal requirements, or to protect legitimate interests. After this period, Personal Data are deleted or anonymized.

Retention periods of Personal Data:

Interest in a property or conclusion of a contract – 10 years from acquisition or termination of the contract, unless a longer period is required by law.
Subscription to marketing communications – 10 years from acquisition or until the subscription is canceled.
Cookies – for the period necessary to achieve their purpose, depending on the type of cookie.
Legal obligations (e.g., Act on the Residence of Foreigners in the Czech Republic, Act on Certain Measures Against the Legalization of Proceeds from Crime and the Financing of Terrorism) – copies of documents and other mandatory records are retained for 10 years from acquisition or transaction, unless otherwise required by law.

After these periods expire, Personal Data are securely deleted or anonymized so that the Client can no longer be identified.

7. CLIENT RIGHTS IN CONNECTION WITH THE PROCESSING OF PERSONAL DATA

Propertino respects Clients’ rights regarding the protection of their Personal Data. The following are the individual rights, along with explanations and how they can be exercised:

Right to Information – The Client has the right to receive clear and understandable information about how Propertino handles their Personal Data and what rights the Client has in this regard. This information is provided in this Personal Data Processing Policy.

Right of Access – The Client may request access to the Personal Data that Propertino holds about them. In some cases, a reasonable administrative fee may be charged. Repeated or unfounded requests may be refused.

Right to Rectification – If Personal Data are inaccurate, outdated, or incomplete, the Client has the right to have them corrected or completed. Changes can be requested by contacting Propertino.

Right to Erasure (“Right to be Forgotten”) – The Client may request the deletion of their Personal Data, provided there are no legal or legitimate reasons to retain them.

Right to Object to Marketing Communications – The Client may unsubscribe from marketing communications at any time by clicking the link in the email. If the Client does not wish their Personal Data to be used for marketing profiling, they may contact Propertino directly.

Right to Withdraw Consent – If Personal Data are processed based on the Client’s consent, the Client may withdraw their consent at any time without affecting the lawfulness of processing prior to the withdrawal.

Right to Object to Processing Based on Legitimate Interest – The Client may object to the processing of Personal Data if they are processed based on Propertino’s legitimate interest.

Right to Lodge a Complaint – If the Client believes that Propertino processes their Personal Data in violation of GDPR, they may file a complaint with the Office for Personal Data Protection (ÚOOÚ). However, it is recommended to first contact Propertino to resolve the issue directly.

Right to Data Portability – The Client may request the transfer, copying, or transmission of their Personal Data from Propertino’s database to another database if the data were provided based on a contract or consent and are processed automatically.

Right to Restrict Processing – The Client may request the restriction of processing of their Personal Data, for example, if the Client (i) contests the accuracy of the data (until verified), (ii) believes processing is unlawful but does not want the data deleted, (iii) Propertino no longer needs the data but the Client requires them for legal claims, or (iv) has objected to processing based on legitimate interest and is awaiting a decision.

Right to Deactivate Cookies – The Client may disable cookies in their browser. This may, however, affect the functionality of the website.

8. EFFECTIVE DATE

These Client Personal Data Processing and Protection Policies are effective as of 16. 2. 2026.
